What Happens After a DWI Arrest in Austin

The sequence, in order
Timings vary, but the order does not.
1. Booking
In Travis County this runs through Central Booking at 500 West 10th Street. Longer holds transfer to the Correctional Complex in Del Valle. Williamson County books at the jail in Georgetown, Hays County in San Marcos.
2. Magistration
You appear before a magistrate who sets bond and its conditions. This usually happens within a day or two. Conditions set here apply from release, months before any finding of guilt.
3. Release
On bond, often a personal bond in Travis County. An ignition interlock may be a condition, and for a charged subsequent offense it is mandatory under article 17.441.
4. The license clock
Running already. The request to contest the suspension is due within 15 days of the notice given at arrest, or 20 days from mailing where a blood draw was taken. See the ALR deadline.
5. Evidence review
Dash camera, body camera and booking video, the offense report, any breath records or blood lab packet, and the warrant affidavit if one was used. This is where a case is actually decided.
6. First court setting
Usually weeks out. By the time it arrives the license window has normally closed for anyone who did not act, which is why the order above matters.
What to do in the first week
Find the paperwork you were given at release. The notice of suspension carries the date the 15 day clock started, and the bond paperwork lists the conditions you are now under. If you do not have either, that is common and not a reason to wait.
Check your bond conditions carefully. People breach them without realising, usually by missing an interlock installation deadline or a reporting requirement. A breach is a separate problem on top of the original charge.
If a blood sample was taken, expect a gap. Results take weeks, and DPS mails the suspension notice when they arrive. Make sure the address on file reaches you, because the suspension takes effect whether or not the letter found you.
Do not assume nothing is happening because no court date has arrived. The license case is moving.
Preserve information that may disappear before the first court setting. Keep the original release, bond, specimen, towing, and property paperwork together, and photograph each page without writing on it. Save receipts, rideshare or location records, and the names and contact details of witnesses who saw the driving, stop, arrest, or events beforehand. Record medication names, prescribed doses, and the time each was taken, but do not alter the original containers or records. Identify nearby businesses, homes, traffic cameras, or vehicles that may have video so a preservation request can be considered before routine overwriting occurs.

How long will I be held?
Booking commonly takes a few hours, with magistration usually within 24 to 48 hours. Release depends on bond being set and satisfied.
Why have I not heard anything from the court?
First settings are usually weeks out. That silence is normal, and it is also why the license deadline is missed so often: nothing appears to be happening while it runs.
What if I never received a suspension notice?
Then it is likely a blood test case. DPS mails the notice once results return, and the deadline is 20 days from mailing.
What is the single most urgent thing?
