If you are under 21, it may not be a DWI at all

Texas treats drivers under 21 under a different statute. Alcohol Beverage Code section 106.041 makes it an offense to operate with any detectable amount of alcohol, with no intoxication required and no 0.08 threshold.

That offense is called DUI in Texas, and it is not a lesser version of DWI. Section 106.041(g) makes it expressly not a lesser included offense, so a student who is actually intoxicated can face a full DWI charge under Penal Code section 49.04 instead.

The consequence that surprises families most: a section 106.041 conviction has no nondisclosure path at all under Government Code section 411.0735(a)(1). It is harder to seal than an adult's DWI. Full detail on my underage DUI page.

The track that is not the courthouse

A criminal case has a defined process. The university side often moves faster and with fewer procedural protections.

A university conduct matter is governed by the institution's own code and is separate from both the criminal case and the driver-license case. The school may begin with an incident report or notice even though the court has made no finding. A later dismissal, plea, or trial result may be relevant, but it does not automatically answer what the school will do under its separate process.

The useful record starts with the school's written notice of alleged conduct and the version of the student code it cites. Conduct-office emails, hearing notices, submitted police reports, and communications involving housing, athletics, scholarships, or a professional program can identify the issue, response deadline, and possible school-specific consequences. Those materials should be preserved and read against the current conduct materials published by UT Austin, Texas State, Southwestern, or Austin Community College, rather than assuming that every Austin-area school uses the same procedure.

Academic consequences

Institutions maintain their own conduct processes with their own standards and timelines. What a particular school does is set by its own code rather than by state law, so it is worth reading yours rather than assuming.

Financial aid and scholarships

Aid and scholarship terms frequently carry conduct conditions. Where they do, a conviction can affect funding independently of any court outcome.

Licensing and future admissions

Professional licensing bodies and graduate admissions commonly ask about criminal history. A record that cannot be sealed follows those applications.

Why the timing is worse for students

The 15 day deadline to contest a license suspension starts at arrest. For a student that often lands during term, exams or a move between addresses.

It gets worse in blood test cases. There, the Department of Public Safety mails the notice once results return, and the deadline becomes 20 days from the date of mailing. If that letter goes to a term address you have left, or a family address you are not at, the suspension takes effect regardless of whether you ever saw it.

Making sure DPS has an address that actually reaches you is a five minute task that prevents a months long problem.

I am 20 and blew under 0.08. Is that still a charge?

Yes. Under 21, the standard is any detectable amount under Alcohol Beverage Code section 106.041. There is no threshold below which it is lawful.

Will my university find out?

Institutions run their own conduct processes with their own reporting rules. What applies to you is set by your school's code rather than by state law, so read it rather than assume.

Can it be cleared from my record later?

If the charge is under section 106.041, no. That offense has no nondisclosure path. An adult DWI can sometimes be sealed, which makes this the reverse of what most people expect.

My address changes between semesters. Does that matter?

It matters a great deal in blood test cases, where DPS mails the suspension notice and the deadline runs 20 days from mailing. Make sure the address on file reaches you.
