Deferred Adjudication for DWI in Texas

Deferred adjudication is available for a first DWI, and it is the main route by which a case avoids becoming a conviction.

Who qualifies, and the two disqualifiers

Article 42A.102(b) makes deferred adjudication available for a first section 49.04 DWI or section 49.06 BWI. Two things remove it entirely.

An alcohol concentration of 0.15 or higher at the time of the offense. Note the measure: at the time of the offense, a time of driving standard. That is not the same measure the charge level uses. Section 49.04(d) is keyed to the concentration at the time the analysis was performed. The two can diverge, so a 0.15 charge does not automatically bar deferred.

Holding a commercial license or permit. Article 42A.102(b)(1)(B)(i) excludes CDL and CLP holders outright, which is one of the reasons a DWI is so much more serious for a commercial driver.

It is also unavailable for child passenger DWI, flying while intoxicated, amusement ride offenses, intoxication assault, intoxication manslaughter, and anything enhanced under section 49.09.

The part that never goes away

A successful deferred adjudication is not a conviction for most purposes. For DWI enhancement it is treated as one, permanently.

Section 49.09(g) makes a DWI or BWI deferred count as a conviction for enhancing any future intoxication offense. There is no expiry. Someone who took deferred at twenty five and is arrested at forty five is charged with a second offense.

People take deferred believing the case disappears. It does not disappear from this. It is still usually the better outcome than a conviction, but it should be chosen with that consequence understood rather than discovered twenty years later.

What deferred gets you

Successful discharge opens an order of nondisclosure after a two year wait under section 411.0726, provided the judge did not enter a finding against future nondisclosure when granting it, and provided the offense did not involve a collision with another person, including your own passenger.

An interlock is mandatory on a DWI or BWI deferred unless waived after an evaluation. That sounds like a cost, and it is also where the only meaningful cost relief in this area lives: article 42A.408(e-1) waives the installation charge and halves the monthly monitoring fee, and it applies only where deferred adjudication is granted. On a conviction there is no equivalent.

Where a county runs a pretrial intervention program instead, completion produces a dismissal that is expunction eligible, which is a stronger outcome again. See Travis County diversion.

Deferred adjudication has its own ending procedure. If the State alleges a violation, it may ask the court to proceed with adjudication under Code of Criminal Procedure article 42A.108. If the conditions are completed, article 42A.111 directs the judge to dismiss the proceedings and discharge the defendant without an adjudication of guilt. That dismissal and discharge is not an acquittal or an expunction and does not automatically remove the arrest and court records.

The motion to proceed, the original deferred order, and the signed dismissal and discharge document establish different stages of the case. Keeping the exact orders matters because a docket label alone may not show what conditions were imposed, whether adjudication occurred, or what order ended the proceedings.

Deferred adjudication questions

Does a 0.15 reading block deferred?

Not automatically. The bar is keyed to concentration at the time of the offense, while the charge level is keyed to the time of analysis. Those measures can diverge.

I have a CDL. Can I get deferred?

No. Article 42A.102(b)(1)(B)(i) excludes commercial license and permit holders.

Does deferred mean the case is gone?

Not for enhancement. Section 49.09(g) makes a DWI deferred count as a conviction for enhancing any future intoxication offense, permanently.

Can I seal it afterward?

Usually, after a two year wait following discharge under section 411.0726, subject to the clean record rule and the collision bar.
